Upon agreement of the trip itinerary and costs, the client will be asked for an advance payment for the tour. Upon receipt of this payment, Japatours will send a written confirmation by email. This confirmation will serve as a legally binding contract for the services requested as per the agreed tour itinerary and details (unavoidable changes bear) once payment of the tour balance has been received (see section 2).
If the applicant registers for several travelers, he will be responsible for all of his contractual obligations as if it were his own. With the conclusion of the contract, if the client agrees to the storage of his / her personal data for use by Japatours to facilitate the visit and only its itinerary. Your personal information will not be sold or misused for any commercial benefit.
To confirm the agreed travel contract, a pre-payment of 30% per person must be paid for all trips. The remaining balance must be paid no later than 90 days prior to departure for all Japan tour trips.
If the client concludes his travel plans with Japatours less than 90 days before departure for a tour in Japan, the tour must be paid in full immediately.
If a customer is unable to pay his / her tour in full before the agreed final payment dates (90 days prior to departure for trips in Japan), the customer risks losing his / her tour. Japatours reserves the right to modify the tour information (by email or detailed on the website) before confirming the trip with the client through a written contractual agreement according to section 1. Japatours has the right to increase the price of the trip after the conclusion of the travel contract as a result of increased transport costs or charges for certain benefits, port or airport taxes or modification of exchange rates that may affect the final costs; Any change can occur up to 4 months before the agreed departure date. If so, the client will be informed immediately, but no later than 21 days before departure. Subsequent price increases are not admissible.
All additional charges that arise due to the modification of the itinerary caused by the client will be debited to the client for immediate payment. The mentioned charges include; Late arrival of the client to the airport or port resulting in lack of boarding, late arrival to trekking excursions, premature departure from the country for any reason (health, personal, legal, etc.), illness or accident incurred during the trip Evacuation, hospitalization, hotel stay for a companion or companion).
If Japatours needs to advance money to attend an acute emergency, then the stated amount must be returned to Japatours immediately after the completion of the trip.
5. Waiver and notice by the tour operator
Japatours can withdraw the travel offer up to 14 days before the start date of the trip if the number of participants required for the tour is not met, but only if the travel description for the corresponding tour refers to a minimum number of participants.
The statement that the minimum number of participants has not been reached and that the trip has been canceled must reach the client no later than 14 days before the trip start date. The customer will receive an immediate refund for any payment previously made, but is not entitled to any additional compensation or claim.
Japatours may withdraw its services after the travel start date if the client is deemed to be in any way disrupting the trip or causing distress to other group members, staff or providers. This also applies if the client does not meet the specific requirements for the tour in question (physical and / or mental health, general abilities, technical skills, where applicable).
If Japatours cancels the trip, the costs incurred up to that date, including advance payments for the services contracted for the tour, will not be refundable. The client will only be entitled to refunds as decided by Japatours in consideration of the travel expenses incurred.

If travel services are not carried out in accordance with the contractual agreement, the responsibility of Japatours depends on national laws. In the case of poor performance that occurs again the client is obliged to immediately complain to the agency or its representative, usually the guide, indicating the problems experienced. If the client wishes to file a claim against Japatours for compensation for breach of contractual obligations, the client must announce his intentions to Japatours within one month from the end of the tour agreed in the contract. Service providers, tour guides or other local agencies are not authorized to receive complaints.
Claims that are raised for the illegal actions of Japatours must be filed within 3 years of the termination of the travel contract under international law. The place of jurisdiction for any claim is Panama City, Panama.
The contractual liability of Japatours for personal injury is limited to a maximum value of the price of the trip, in the event of negligence on behalf of Japatours.
Compensation requested for damage to persons or property due to negligence on the part of service providers must be directed to the service provider and is not the responsibility of Japatours.
It should be noted that for mountaineering, trekking and expeditions there is a greater risk of accidents due to the nature of these adventure sports (for example, avalanches, rock falls, column falls, water travel, river crossings, etc. ).
These risks are always present and cannot be reduced or even excluded by the most prudent and cautious care of the assigned tour guides / guides. Therefore, participation in adventure activities such as mountaineering, trekking, horseback riding, rafting, mountain bike rides and general expeditions or trips that involve even minimal elements of danger, are always at the clients own risk and responsibility.
If the trip is substantially difficult or dangerous and incorporates the risk of any nature arising from circumstances (for example, war, strike, riots, epidemic diseases, sovereign settlement, among others), then the client and Trip to Japan can withdraw from him or cancel the travel contract.
In the case of emergency procedures for unforeseen circumstances, the client is responsible for the full extent of the expenses incurred (for example, hospitalization, accommodation and additional food) with the exception of emergency transportation to which Japatours will contribute up to 50% of the total cost. Any other demands are excluded.
The traveler is responsible for complying with the entry and health regulations, passport, customs requirements, visas, and exchange import regulations at themselves and at their own costs. All the inconveniences and expenses that derive from the indifference to these regulations are responsible to the client, even if the regulation changes have been modified after making the reservation. If possible, Japatours will inform customers of important changes to the general regulations as described in the travel descriptions of the tours before the start of the tour.
